Terms and conditions applicable to the use of lockers for the sale of products/objects
The following Terms and Conditions apply to the use of Lockers owned by Intelligent Retail Solutions (hereinafter referred to as “InRetailS”), single registration and VAT number 516 223 763 with registered office at Centro Empresarial Inovagaia, Av. Manuel Violas, 476, Sala 7.2, 4410 – 137 S. Felix da Marinha.
The lockers are exclusively made available for selling products/objects, under the responsibility and at the premises of the SUPPLIER, hereinafter referred to as POS.
By accessing and using the mobile application, as well as the POS facilities and/or the respective lockers, the USER declares that (i) they have read and accept, fully and without reservation, these terms and conditions, which constitute a binding agreement between InRetailS, POS and the USER, (ii) they are not prevented, by any legal provision or any other reason, to be bound by and comply with these terms and conditions.
If you do not agree with the terms and conditions, you should not access or use the mobile application, nor use the services provided therein, and you should refrain from accessing and using the POS facilities and their lockers.
The USER is entirely responsible for the use of the application and the services provided therein, for the use of the POS facilities and the respective lockers.
These terms and conditions, and other rules or guidelines regarding the use of the POS facilities and respective lockers, the configuration of the mobile application or the content and services made available therein, may, at any time, and at the sole discretion of InRetailS or POS, be changed, and it is the responsibility of the USER to regularly check the updated terms and conditions.
The terms and conditions and subsequent amendments are considered effective and binding on the USERS, after being duly advertised on the www.pick-a-buy.com POS website, or alternatively, in a smaller version that will be posted inside the POS facilities.
CLAUSE ONE
(OBJECT)
These terms and conditions govern the organization, use and operation of CACIFOS and respective POS facilities, through the Pick-a-Buy application, and apply to all CACIFOS and USERS.
SECOND CLAUSE
(LOCKERS)
1. LOCKERS with dimensions 40 x 40 x 40 cm, are exclusively intended for the safekeeping of products/objects by USERS.
2. The LOCKERS are designed for autonomous use, and the USER must follow the operating instructions available in the mobile application.
3. The LOCKERS operate 24 hours a day, 365 days a year, without prejudice to the fact that they may be closed for reasons of force majeure, considering as such any event that endangers USERS or deposited objects, and also if there is a need to repair the LOCKERS or related equipment.
4. The closure of the LOCKERS under the terms provided for in the preceding paragraph shall be communicated to THE USERS, as soon as such need is known.
THIRD CLAUSE
(PRICE)
1. The USER of the LOCKERS undertakes to pay for the products/objects inside them, the price set in the lockers at the POS and/or available in the application, which may be reviewed periodically, without any direct notice to each USER.
2. If, for any reason, the payment has not been made, InRetailS reserves the right to prevent the opening of the CACIFO.
CLAUSE FOUR
(GENERAL DUTIES AND OBLIGATIONS OF THE USER)
1. By using the LOCKERS, the USER undertakes, without any limitation, to:
a. Not to use the LOCKERS in violation of any laws, rules, regulations or for illegal or unauthorized purposes;
b. Use the LOCKERS for the sole purpose of acquiring the products/objects available inside;
c. Not to place any objects of any kind inside the LOCKERS, being fully responsible for the damages or losses resulting therefrom caused to InRetailS, to themselves or to third parties;
d. Comply with the instructions given by the entities that ensure the management, security, maintenance, conservation and cleaning of the CACIFOS;
e. Diligently use the LOCKERS and, in particular, ensure that they have been properly closed, after the USER has collected the products/objects;
f. Leave the CACIFO in the same state and conditions assigned to it, and immediately inform of any incident that occurred during the use of the CACIFO;
g. Not to disturb in any way the use of the LOCKERS by other users, namely not to occupy any area that hinders or makes impossible access to and use of the LOCKERS;
CLAUSE FIVE
(GENERAL DUTIES AND OBLIGATIONS OF THE SUPPLIER)
1. By making the CACIFOS, the POS undertakes, without any limitation, to:
a. Not to make products/objects available or to occupy the LOCKERS in violation of any laws, rules, regulations or for illegal or unauthorized purposes;
b. Use the LOCKERS for the sole purpose of marketing the products/objects available inside;
c. Comply with the rules of hygiene and safety, namely to ensure the management, safety, maintenance, conservation and cleaning of the LOCKERS;
SIXTH CLAUSE
(SECURITY)
For the protection of USERS, the POS facilities where the LOCKERS are located are under permanently active lighting and video surveillance, which is expressly authorized by the USER, with the acceptance of these terms and conditions.
CLAUSE SEVEN
(ASSISTANCE)
The USER has at their disposal contacts for communication that ensures support 24 hours a day, and the respective contacts are posted inside the POS facilities.
CLAUSE EIGHT
(RESPONSABILIDADE PRODUTOS/OBJECTOS EM VENDA)
1. The USER of the LOCKERS is solely and fully responsible for any damages caused to InRetailS, POS or third parties, resulting from the use of the LOCKERS or the products/objects contained therein.
2. In the event of theft, robbery or loss, the USER must file a complaint with the nearest police station and immediately communicate it to InRetailS, through the email address geral@pick-a-buy.com or to the contact provided by the POS within a maximum period of 24 hours, attaching a copy of the complaint.
3. The USER assumes responsibility for the cost of repairing or replacing any CACIFO that has been damaged.
